Will of William L. Gilbert

In the Name of God Amen I William L Gilbert of the County of Jasper and State of Missouri
being of sound mind and disposing memory and considering the uncertainty of this frail and
transitory life do therefore make Publish and declare this to be my last Will and Testament
revoking all former will by me made That is to say: after all my just and lawful debts are paid
and discharged in full the rest and residue of my Estate real personal and mixed I give bequeath
and dispose of as follows. To my beloved brother James L Gilbert I give and bequeath the sum of
Fifty Dollars cash.
To the wife of my beloved brother A. B. Gilbert (Towit Mary Gilbert) I give and bequeath the
sum of Fifty Dollars cash. All the balance of my Estate real personal and mixed whether located
here or elsewhere or which I may hereafter acquire, and consisting of any property or right
whatsoever I give bequeath and devise to my beloved nephews Hiram Phillips and James P Gilbert
in the following proportions towit: To Hiram Phillips I give bequeath and devise two thirds of
the balance of my Estate aforesaid after paying said debts and special legacies aforesaid
absolutely and in fee simple to have and dispose of as he may see fit and to his own use and
benefit: To James P Gilbert aforesaid I give bequeath and devise One Third of all of said balance
of my Estate aforesaid after said debts and special legacies aforesaid are paid, absolutely and
in fee simple to do with and dispose of as he may see fit and to use and leave for his own use
and benefit I hereby make constitute and appoint my said nephews Hiram Phillips and James P
Gilbert Executors of this my last will and testament and it is my further wish that they be not
required to give bond.

The above written instrument was subscribed by said William L. Gilbert in our presence and
acknowledged by him to each of us and he at the same time published and declared the above
written instrument so subscribed to be his last will and testament and in his presence and in
the presence of each other have signed our names as witnesses hereto and written opposite our
names
N.B. - Date of Death is 8 Dec 1905, and the will was probated 30 Apr 1906.
The witness page has been lost over time, and so is not included.

deposes and says, that he is the appraiser of the estate of the above named decedent who departed
this life on the 8th day of Dec 1905, that at the date of the death of the said decedent, the

Be it Remembered, That on this 14th day of April 1906, before me Judge of the Probate Court of
Jasper County, personally appeared Hiram Phillips and James P. Gilbert Executors of WL Gilbert
deceased late of [blank] County, Missouri, who being by me buly sworn, on their oath says that
the foregoing is a full Inventory and description of all moneys, goods, chattels and estates,
real and personal, books, papers, evidences of debt, and of title of the said deceased, and of
all debts due or becoming due, so far as they can ascertain them and that they was not indebted
or bound in any contract to the deceased at the time of his death, except as stated in said
Inventory.
